These Terms of Use ("Terms") are an agreement between you and AnesPilot LLC ("AnesPilot," "we," "us") for the AnesPilot mobile app (the "App"). By downloading or using the App, you agree to these Terms. If you do not agree, do not use the App.
2.1 Who may use the App
You must be at least 18 years old, or the age of majority where you live, to use the App. The App is intended for healthcare students, trainees and professionals, and for general education.
2.2 Educational use only; not medical advice
The App provides general educational and reference information about anesthesia. It is not medical advice, is not a medical device, and does not diagnose, treat, cure or prevent any condition. It does not replace your training, your clinical judgment, your supervising provider, your institution's policies, current product labeling or current clinical guidelines. The full Medical and Educational Disclaimer (on this website) is part of these Terms.
2.3 License
We grant you a personal, non-exclusive, non-transferable, revocable license to use the App on Apple- or Google-branded devices that you own or control, as permitted by the usage rules of the App Store or Google Play. You may not:
- copy, sell, rent, lease, sublicense or redistribute the App or its content;
- reverse-engineer, decompile or take apart the App, except where the law allows it;
- remove copyright or other notices;
- use the App's content to build a competing product, or to train an AI model, without our written permission.
2.4 Your content
Your notes, pictures, files and other content ("Your Content") belong to you and stay on your device. You are responsible for Your Content. Do not put information that identifies a patient into the App. Only import or upload material you have the right to use.
2.5 The AnesPilot Assistant and other outside services
AI features are provided through the AnesPilot Assistant on claude.ai, which runs on your own Claude account. Your use of Claude is governed by Anthropic's terms and policies, not by us. You may need a Claude account, and possibly a paid Claude plan, to use these features. We do not control Anthropic's service, we do not guarantee that it will be available, and we may change or remove the Assistant link. AI output can be wrong or incomplete. Check every output before you rely on it, and never submit AI-drafted coursework or clinical documents without reviewing them and following your program's rules on AI use.
Links to other websites are provided for convenience. We are not responsible for their content or practices.
2.6 Acceptable use
Do not use the App to break any law, to violate anyone's privacy or intellectual property rights, to store or share protected health information, or to make clinical decisions without appropriate supervision and verification.
2.7 Our content and ownership
The App, including its text, drug and block references, illustrations, figures, design and software, is owned by AnesPilot LLC or its licensors and is protected by copyright and other laws. The Copyright and Trademarks page lists third-party trademarks and sources. Except for the license in Section 2.3, these Terms give you no rights in the App.
2.8 Purchases, updates and refunds
The App is sold through the Apple App Store and Google Play. Payment, refunds and family sharing are handled by Apple or Google under their own rules; we cannot issue refunds directly. We may update the App at any time, and some features may change or be removed. We are not required to provide updates or support, but we will try to.
2.9 Disclaimer of warranties
THE APP AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT ALLOWED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, COMPLETENESS, CURRENCY AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE ERROR-FREE OR UNINTERRUPTED, OR THAT ANY DOSE, VALUE OR STATEMENT IN IT IS CORRECT FOR ANY PATIENT.
2.10 Limitation of liability
TO THE FULLEST EXTENT ALLOWED BY LAW, AnesPilot LLC AND ITS OWNERS, EMPLOYEES AND CONTRIBUTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY PATIENT CARE OUTCOME, LOSS OF DATA, OR ACADEMIC OR EMPLOYMENT CONSEQUENCE ARISING FROM YOUR USE OF THE APP. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID FOR THE APP OR US$50. Some places do not allow these limits, so some of them may not apply to you.
2.11 Indemnity
You agree to defend and hold harmless AnesPilot LLC from claims arising from your misuse of the App, Your Content, or your breach of these Terms, to the extent the law allows.
2.12 Ending these Terms
You may stop using the App and delete it at any time. We may end your license if you break these Terms. Sections 2.4, 2.7 and 2.9 to 2.16 survive.
2.13 Governing law and disputes
These Terms are governed by the laws of the State of Montana and applicable US federal law, without regard to conflict-of-law rules. Before filing a claim, please email theanespilot@gmail.com so we can try to resolve it informally within 60 days. Any lawsuit must be brought in the state or federal courts located in Gallatin County, Montana, and you and we consent to those courts. Either of us may bring a qualifying claim in small-claims court instead. Nothing in this section limits rights you have under the mandatory consumer laws of where you live.
2.14 Export and legal compliance
You confirm that you are not located in a country subject to a US government embargo, and that you are not on any US government list of prohibited or restricted parties.
2.15 App Store terms (required by Apple)
If you got the App from the Apple App Store:
a. These Terms are between you and AnesPilot LLC only, not Apple. AnesPilot LLC, not Apple, is solely responsible for the App and its content. b. Your license is limited to using the App on Apple-branded products you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions. c. Apple has no obligation to provide maintenance or support for the App. d. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation for the App. Any other claims, losses, liabilities, damages, costs or expenses from a failure to conform to a warranty are AnesPilot LLC's responsibility, to the extent not disclaimed in these Terms. e. AnesPilot LLC, not Apple, is responsible for addressing any claims by you or a third party relating to the App or your use of it, including product liability claims, claims that the App fails to meet any legal or regulatory requirement, and claims under consumer protection, privacy or similar laws. f. If a third party claims that the App or your use of it infringes their intellectual property, AnesPilot LLC, not Apple, is solely responsible for investigating, defending, settling and discharging that claim. g. You must comply with any applicable third-party terms when using the App. h. Apple and its subsidiaries are third-party beneficiaries of these Terms, and once you accept them, Apple has the right (and is deemed to have accepted the right) to enforce them against you. i. If you got the App from Google Play, Google's Play Terms of Service also apply, and Google is not responsible for the App.
2.16 General
These Terms, together with the Privacy Policy and the documents they refer to, are the whole agreement between you and us about the App. If a part is found unenforceable, the rest stays in effect. Our not enforcing a term is not a waiver. You may not transfer these Terms; we may transfer them as part of a sale or reorganization of our business. We may update these Terms by posting a new version; if a change is material, we will tell you in the App, and continuing to use the App after it takes effect means you accept it.
